Welcome to GFEB Learning Platform (“the Platform”). By accessing or using our Platform, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use or access the Platform.
1. Definitions
- “Platform” refers to the Learning Management System, including its websites, subdomains, mobile applications, and any related services.
- “Company” refers to GFEB Project, the entity that owns and operates the Platform.
- “User(s)” refers collectively to anyone accessing or using the Platform, including Instructors and Students.
- “Instructor(s)” refers to users who create and manage courses, upload content, and provide educational materials on the Platform.
- “Student(s)” refers to users who enroll in and participate in courses provided on the Platform.
2. Eligibility
- Age Requirement: Users must be at least the age of majority in their jurisdiction (often 18 years old) to register for an account on the Platform. If you are under the age of majority, you may only use the Platform under the supervision of a parent or guardian who agrees to these Terms.
- Compliance: By using the Platform, you represent and warrant that you meet all legal requirements to form a binding contract and are not barred from using the Platform under any applicable laws.
3. User Accounts
- Account Creation: To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and keep this information up to date.
- Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify the Company immediately of any unauthorized use of your account.
- Multiple Accounts: You must not create multiple accounts for fraudulent or malicious purposes, or otherwise misuse the Platform’s features.
4. Instructor Obligations
- Course Creation: Instructors may create and publish courses on the Platform. Instructors are solely responsible for the accuracy, completeness, and quality of the content they upload.
- Compliance with Laws: Instructors must ensure that their courses and content comply with all applicable laws, regulations, and third-party rights. Content must not be false, misleading, infringing, or otherwise unlawful.
- Interaction with Students: Instructors agree to communicate respectfully and professionally with Students. Any disputes arising from course content or communication must be handled responsibly and in accordance with these Terms.
- Payment and Revenue Sharing: If the Platform includes paid courses or revenue-sharing models, Instructors will be subject to additional terms governing payments, fee structures, and payout schedules. These will be provided separately or in an annex to these Terms.
5. Student Obligations
- Course Enrollment: Students may enroll in courses provided on the Platform. Enrollment may be free or paid, depending on the course and the Instructor’s pricing policy.
- Academic Integrity: Students agree to uphold principles of academic integrity, avoiding plagiarism, cheating, or any other form of misconduct.
- Respectful Conduct: Students must interact respectfully with Instructors and peers in discussions, forums, and any other communication channels on the Platform.
6. User Conduct
- Prohibited Activities: You agree not to:
- Post or transmit any content that is unlawful, harassing, discriminatory, defamatory, or otherwise objectionable.
- Infringe upon the intellectual property, privacy, or other rights of any third party.
- Attempt to gain unauthorized access to the Platform, servers, or networks connected to the Platform.
- Use the Platform to distribute any malware, viruses, or any other harmful software.
- Engage in any activity that disrupts or interferes with the normal operation of the Platform.
- Reporting Misconduct: If you become aware of any misuse or violation of these Terms, you agree to notify the Company immediately.
7. Intellectual Property
- Platform Content: The Platform, including its interface, design, underlying software, and all content provided by the Company, is the exclusive property of the Company and/or its licensors. Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for personal and non-commercial purposes.
- User-Generated Content: Instructors retain ownership of the content they create and upload. However, by posting content on the Platform, Instructors grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display this content for the purpose of operating and promoting the Platform.
- Third-Party Content: Any third-party materials (such as videos, articles, or external links) remain the property of their respective owners. Users are responsible for ensuring they have the necessary permissions to use such content.
8. Privacy Policy
Your use of the Platform is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in our Privacy Policy.
9. Disclaimers
- No Guarantee of Course Quality: The Company does not guarantee the accuracy, completeness, or quality of any course content. The responsibility lies solely with the Instructor providing the course.
- No Warranties: The Platform is provided on an “as is” and “as available” basis. The Company disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability, and non-infringement.
- Limitation of Liability: To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. In all cases, the Company’s total liability will not exceed the amount paid by you, if any, to use the Platform.
10. Indemnification
You agree to indemnify and hold harmless the Company, its affiliates, officers, employees, and agents from any claims, damages, losses, or liabilities arising out of or related to:
- Your violation of these Terms.
- Your violation of any third-party rights, including intellectual property or privacy rights.
- Any content you upload or post on the Platform.
12. Termination
- Voluntary Termination: You may discontinue your use of the Platform at any time by deactivating your account.
- Termination by Company: The Company reserves the right to suspend or terminate your account, without prior notice, if you violate any of these Terms or engage in activities harmful to the Platform or its users.
- Effects of Termination: Upon termination, your right to use the Platform will immediately cease. Any data associated with your account may be retained or deleted at the Company’s discretion, subject to applicable laws.
13. Modifications to the Terms
The Company reserves the right to update or modify these Terms at any time. In such cases, we will post the revised Terms and update the “Last Updated” date. Your continued use of the Platform after any changes indicates your acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
- Governing Law: These Terms and any dispute arising out of or related to them shall be governed by the laws of [Jurisdiction], without regard to conflict of law principles.
